1. Introduction

SignatureRx is a digital health platform provided by Members Health Inc. ("MHI"), located at 121 King Street West, Suite 2150, Toronto, Ontario, M5H 3T9, Tel. 1-800-484-0152, www.membershealth.ca. These Terms of Use govern your access to and use of the SignatureRx platform and associated services ("the Services"). By accessing or using SignatureRx, you agree to be bound by these Terms of Use and the Privacy Policy.

2. Nature of Services

SignatureRx enables you to access healthcare services provided by independent third-party physicians, specialists, and allied healthcare providers through virtual means, including phone, email, text, chat, and videoconferencing. Services may be provided as part of a benefit through your employer, union, or association, or may be purchased directly by you.

3. Consent and Use of Electronic Communications

By using SignatureRx, you:

  • Consent to the use of electronic communications for the delivery of healthcare services.
  • Understand that electronic communications have inherent risks, including potential data breaches, unauthorized access, or miscommunication.
  • Acknowledge that although encryption and security protocols are in place, complete security cannot be guaranteed.
  • Agree to use secure devices and networks when accessing the Services.

4. Physician and Provider Access

All providers available through SignatureRx are independently licensed and regulated by their respective colleges (e.g., CPSO for Ontario). SignatureRx and MHI act solely as facilitators and coordinators of care and do not directly provide medical services.

5. Limitations and Risks

You acknowledge that:

  • Virtual care may not be appropriate for all medical conditions.
  • Services are not intended for emergencies. In case of an emergency, call 911 or go to the nearest emergency department.
  • You may be advised to seek in-person care based on your symptoms.
  • There is no guarantee of response times.

6. Personal Information and Privacy

SignatureRx complies with the Personal Health Information Protection Act (PHIPA) and applicable Canadian privacy legislation. By using the Services, you:

  • Consent to the collection, use, and disclosure of your personal and health information as necessary to deliver the Services.
  • Understand that your information will not be sold or shared with third parties for financial gain.
  • Acknowledge that you may request access, correction, or deletion of your information by contacting support@membershealth.ca.

7. Record Keeping and Communication

  • Communications and treatment details may be documented in an Electronic Medical Record (EMR).
  • Your information may be shared with other healthcare providers involved in your care, with your consent or as required by law.
  • Communications may include prescriptions, referrals, diagnostic requisitions, or follow-ups.

8. Appropriate Use

By using the Services, you agree:

  • Not to use SignatureRx for unlawful or inappropriate purposes.
  • To provide accurate and complete information.
  • To maintain confidentiality of login credentials.

9. Intellectual Property

All content, branding, and materials on the SignatureRx platform are the intellectual property of Members Health Inc. and may not be reproduced without permission.

10. Termination and Withdrawal of Consent

  • You may withdraw consent or terminate your use of the Services at any time by contacting support@membershealth.ca.
  • MHI or its providers may also suspend or terminate access with notice.

11. Updates and Changes

Members Health Inc. reserves the right to modify these Terms of Use at any time. Updated terms will be posted on the SignatureRx website and effective immediately unless stated otherwise.
